Americans with Disabilities Act
Just in case you're curious, the American's with Disability Act (ADA) prohibits discrimination based on disability. We recommend The Department of Justice's excellent website that gives information and technical assistance to anyone with questions on a variety of topics. It can be accessed at www.ada.gov. On that site, you can find the full text for the ADA and the Code of Federal Regulations (the regulations that implement the law). The following are some of the applicable sections. We recommend skimming the full text.
Under title III, section 12182 (a). the general rule states that:
"No individual shall be discriminated against on the basis of disability in the full and equal enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of any place of public accommodation by any person who owns, leases (or leases to), or operates a place of public accommodation."
(b)(1)(B) Integrated settings
"Goods, services, facilities, privileges, advantages, and accommodations shall be afforded to an individual with a disability in the most integrated setting appropriate to the needs of the individual." In other words, access to public golf courses.
The Code of Federal Regulations (CFR) is the Department of Justice's regulation implementing title III of the ADA, which prohibits discrimination on the basis of disability in "places of public accommodation" (businesses and non-profit agencies that serve the public) and "commercial facilities" (other businesses). This document is also found on the website.
Section 36.104 defines "Place of public accommodation means a facility, operated by a private entity, whose operations affect commerce and fall within at least one of the following categories . . . (12) A gymnasium, health spa, bowling alley, golf course, or other place of exercise or recreation."
Sec 36.211 Maintenance of accessible features. States that
"(a) A public accommodation shall maintain in operable working condition those features of facilities and equipment that are required to be readily accessible to and usable by persons with disabilities by the Act or this part."
